These Terms of Use apply to all individuals who use the Services provided by Pensure AB ("Pensure"), org no 559114-1865, on its website. By accessing Pensure's website, the visitor agrees that the Terms of Use are binding on the visitor.

These Terms of Use apply to all individuals who use the Services provided by Pensure AB ("Pensure"), org no 559114-1865, on its website. By accessing Pensure's website, the visitor agrees that the Terms of Use are binding on the visitor.
Individuals who contract with Pensure for additional services or features will be able to benefit from specific terms and conditions tailored to each additional service or feature.
2. Definitions
The following words and terms used in the Terms of Use or in the Services offered by Pensure shall have the meanings set forth below.
"Administrator" means the person or persons to whom the Business Customer has granted administrative rights. The Administrator has the right to order additional services for the Business Customer and to manage roles in the web-based application.
"Employee" means any individual registered by the Business Customer in the web-based tool.
"User Data" is personal data about the Individual that is necessary for the Individual to use the Services. Examples of such data are social security number, name, email address and telephone number.
"Insurance Information" is information about Employee insurance policies taken out with insurance companies by you or your employers. This information is used to provide Employees with an overview of their overall insurance situation and to give them personalised advice.
"Individual" means the user of the Services offered by Pensure. An Individual may be either an Administrator, Employee, Partner or other user of the Service.
"Customer data" is the information about the Employee that is needed to manage the Employee's occupational pension and other insurance on an ongoing basis. Examples of such data are name, personal identity number, e-mail address, telephone, salary, premium, health declarations. In addition, Pensure is required to comply with a number of external regulations, which means that additional data is collected via direct queries to the Employee.
"Partner" means the individual(s) who collaborate with Pensure in relation to the Services offered by Pensure.
"Services" means access to the Pensure web-based program and the Additional Services ordered or accessed by the Individual.
3. Individual responsibility
The individual is responsible for ensuring that the information entered into the Services is accurate and that it does not violate any applicable laws. Pensure cannot be held responsible for any inaccurate information entered by the Individual in any of the Services. This applies in particular to the information provided by the Individual and then sent to the Insurer.
Individual may not allow another individual to log in, access, or otherwise appear in Individual's name.
The Individual acknowledges and agrees that the content of the Services, including text, graphical content and methodology of the Services, is the property of Pensure. The Individual does not acquire any right to the content but has the right to temporarily use the content necessary for the Individual to access the Services.
The Terms of Use do not transfer copyright or other intellectual property rights in the Services to the Individual. Individual may not copy or modify any software or other material belonging to Pensure.
Use of the Services requires that the Individual have up-to-date hardware and software. This is the responsibility of the Individual.
4. Amendment of the Terms of Use
Pensure has the right to modify these Terms of Use without the prior consent of the Individual. The Individual will be notified of such changes at the time the Individual uses the Services.
5. Fees and costs
In the Services offered by Pensure, Individuals may contract for additional services or features for a fee. The fee is set out in the specific terms and conditions agreed by the Individual at the time the agreement for the additional service or functionality is entered into. The agreements include a description of how and when the fee is to be paid.
6. Development and change
The individual is aware that Pensure continuously updates and develops Services. This may result in planned downtime and changes to the Services which Pensure shall inform the Individual of. Furthermore, Pensure shall describe to the best of its ability the adaptations that the Customer needs to make in order to use the Services.
7. Personal data
Pensure stores data about Individuals to enable the use of Services, to fulfill its obligations to its customers, to fulfill its obligations to public authorities and to comply with legal requirements.

8. Data management
Pensure shall maintain a good level of security, compared to industry standards, and comply with current legislation regarding data management.
Pensure shall establish its own data management policy, which shall be described on the company's website from time to time.
In particular, Pensure
shall not store or collect more data than is necessary for the contracted Services or as required by applicable laws and regulatory recommendations.
shall not give third parties access to Customer Information unless it is required for the performance of Services.

9. Disclaimer
Force Majeure are situations that are reasonably beyond Pensure's control such as security threats, virus warnings, attacks on Services, situations related to terrorist attacks, power outages or other interruptions related to third parties. In said situations, Pensure has the right to withhold performance of Services but only for the time that performance is prevented and provided that Pensure attempts to inform the Individual.
Further, Pensure's liability shall not exceed thirty (30) percent of the licenses paid by the Individual during the past 12 months or be liable for lost profits, goodwill loss, consequential or other indirect damages of any kind whatsoever. Individual further agrees to indemnify and hold Pensure harmless from and against any and all claims by third parties relating to damage and loss caused by Individual or another's use of the Services.
